Rebecca Procter is a Partner in the firm’s Construction Defect Group. Ms. Procter has spent the last decade representing community associations in complex construction defect negotiations and litigation, and counseling boards of directors in their communication and dealings with developers, contractors, and materials suppliers.

Before joining Riley Pasek Canty LLP, Ms. Procter was a Partner at a large construction defect litigation firm on the west coast, where she represented building owners, associations, developers and general contractors in Hawaii, California and Arizona. Ms. Procter specializes in working with boards and management companies to identify, monitor, and address common area maintenance and repair obligations.

Over the last 14 years, Ms. Procter has built a reputation as a skilled negotiator, with a pragmatic and cost-efficient approach to resolving construction disputes. Ms. Procter advocates for her clients by understanding the brass-tax details of each property and having early, candid, and reasoned dialogue with opposing parties. Ms. Procter aims to protect her clients from the stigma and disclosure obligations that come with construction defect litigation but, when necessary, is aggressive in the courtroom and will advocate zealously to protect her client’s investments.

Ms. Procter has expertise in negotiating and litigating repairs to a wide range of technical construction problems, including concrete foundation systems, direct-applied finish systems (DEFS) (used throughout Hawaii), hardboard and fiber siding, geotechnical and soil compaction issues, drainage problems, fire-sprinkler systems, HVAC, and PEX plumbing systems.

Ms. Procter leads the firm’s Hawaii and Arizona operations. Over the last decade, Ms. Procter has been integrally involved in negotiating a settlement resulting in $155 million in repairs to a luxury high-rise condominium in Honolulu, recovering $29.5 million for a large Oahu condominium association with over 500 single-family and multi-family units, and settling plumbing and HVAC issues for $9 million for a luxury condominium project in Wailea with 80 townhome units.

Ms. Procter is regarded by her clients as having the unique ability to digest complex technical construction and legal concepts and communicate them in a way that makes sense, both from a lay person’s understanding, and just plain common sense.
